SnapItAgent Terms of Service

By accessing and using SnapItAgent ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

3. User Accounts

AI Processing Disclosure: Our Service uses third-party AI providers (including Google Gemini, OpenAI, and DeepSeek) to generate chatbot responses. By using the Service, you acknowledge that:

• Conversation data between your chatbot and end users is sent to AI providers for response generation.
• You are responsible for informing your end users that they are interacting with an AI-powered chatbot.
• You must not use the Service to collect or process sensitive personal data (health records, financial account numbers, government IDs) through chatbot conversations without appropriate safeguards.
• AI-generated responses may not always be accurate. You are responsible for configuring your agent with correct business information.
• SnapIT Agent does not guarantee the accuracy, completeness, or appropriateness of AI-generated responses.

7. AI-Generated Content

SnapIT Agent uses artificial intelligence to generate responses. You acknowledge and agree that:

• AI-generated responses may not always be accurate, complete, or appropriate.
• SnapIT Agent is not responsible for actions taken based on AI-generated responses.
• You are responsible for reviewing and verifying AI-generated content before relying on it.
• AI models are provided by third-party providers (Google, DeepSeek, OpenAI) and are subject to their respective terms of service.
• You agree not to use AI agents for medical, legal, or financial advice without appropriate disclaimers to your end users.

8. Service Availability

We strive to maintain high service availability but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

To the maximum extent permitted by law, SnapItAgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless SnapIT Software, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Service
• The deployment of AI agents on your website or application
• Your violation of these Terms
• Your violation of any rights of another party
• Any content or data you provide to or through the Service

12. Intellectual Property

The Service and its original content, features, and functionality are owned by SnapIT Software and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

13. DMCA Notice

If you believe that content available through SnapIT Agent infringes your copyright, please send a DMCA takedown notice to support@snapitagent.com with the following information:

• A description of the copyrighted work that you claim has been infringed.
• A description of the location of the infringing content on the Service.
• Your contact information (name, address, telephone number, and email address).
• A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
• Your physical or electronic signature.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. You may also terminate your account at any time by contacting us.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.
